What is a United States Electronic System For Travel Authorization (ESTA)?

The Electronic System for Travel Authorization (ESTA) is an online system that is used to determine the eligibility of travelers from Visa Waiver Program (VWP) countries to enter the United States for short visits without obtaining a visa. It is an authoritative and automated system that can be used for business or pleasure purposes only. It is crucial to keep in mind that ESTA solely permits travel to a U.S. airport, border, or port of entry. The ultimate verdict on whether an individual can enter the United States or not is determined by a U.S. Customs and Border Protection (CBP) officer upon their arrival.

The US immigration code is the body of law that governs the entry and stay of foreign nationals in the United States. It is contained in Title 8 of the United States Code, which is also known as the Immigration and Nationality Act (INA).

The INA is a complex law, but it can be broadly divided into two main parts:

  • Part I: Selection System: This part of the INA establishes the different visa categories that are available to foreign nationals who wish to immigrate to the United States. It also sets forth the procedures for applying for immigrant visas and for adjusting one’s status to lawful permanent resident (LPR) while in the United States.
  • Part II: Immigration: This part of the INA governs the entry and stay of nonimmigrant aliens, such as tourists, business travelers, and students. It also sets forth the procedures for enforcing US immigration laws and for removing nonimmigrant aliens who have violated those laws.
